Richard Clare is the Chair of the firm's Real Estate Law Practice Group. Richard specializes in real estate and commercial law, with considerable expertise in real estate development, portfolio dispositions and acquisitions and financings. He acts for banks, life insurance companies and pension funds in structuring construction or permanent financing. He regularly advises purchasers, vendors, developers and real estate agents on issues relating to the sale, purchase, development and zoning of buildings and in matters relating to commercial leases. His advice is frequently sought by the hotel industry, particularly in respect of hotel franchise agreements and management contracts.
Mr. Clare has developed an expertise in the use of emphyteutic and usufruct structures as a tax advantage for non-profit entities. He structures mixed-use projects using divided co-ownership (horizontal and vertical) and rights of superficies. He is also consulted frequently on the establishment of pipelines, wind turbine parks and fiber optic networks and in respect of mining operations.
