Alex Cameron is a Partner with Fasken Martineau in Toronto and Leader of the firm’s Privacy & Information Protection Group. Alex has a leading practice in the areas of privacy and cybersecurity, access to information, Canada’s anti-spam law (CASL). An accomplished litigator, Alex has acted as lead counsel in commercial disputes and landmark cases in his areas of practice, including data breach class action defence, and before all levels of court, including the Supreme Court of Canada. Alex was recently selected for inclusion in The Best Lawyers in Canada 2017 in the field of Privacy and Data Protection Law and Chambers Canada 2017 for Privacy and Data Protection.
Alex is consistently sought out by clients from all industry sectors, including numerous Fortune 100 and Fortune 500 companies, in all aspects of privacy law and information security. He works closely with clients and outside security experts to help clients identify and manage cybersecurity and related legal risks, including through strategic risk assessments, risk transfer, and incident response planning. Alex is lead panel counsel for leading cyber insurers and has acted as breach coach and counsel in many landmark cyber-security and data breach matters. Alex has wide and varied experience in helping clients respond to all manner of data breach incidents, including:
- Cyber extortion in the context information theft, DDoS attacks and ransomware
- Large-scale ransomware attacks
- Sophisticated hacking, malware and phishing attacks
- Lost and stolen laptops, drives and paper information
- Business practice claims (e.g. alleged misuse of information for commercial purposes)
- Data breaches impacting payment cards and PCI rules
- Careless, snooping and rogue employees
- Vendor and service provider breaches
A seasoned litigator, Alex’s has defended clients in numerous regulatory inquiries, complaints and investigations, and in litigation, in relation to privacy and data breaches.
In the access to information field, Alex assists clients in making strategic requests under freedom of information laws to obtain valuable information, including information about competitors, procurement and government relations. He also assists clients in resisting disclosure of sensitive information in circumstances where it is the subject of a request, including information submitted for approvals, as part of a reporting obligation or investigation, or in a bid responding to a request for proposal (RFP). Alex has also advised select institutions subject to access to information law on high-profile matters, including the City of Markham in relation to the $325 million GTA Centre. He has also acted as lead counsel in numerous provincial and Federal court challenges in relation to freedom of information requests.
Alex was a Director on the Advisory Board of the International Association of Privacy Professionals (IAPP) Canada and Past Chair of the Canadian Bar Association (CBA) National Privacy & Access Law Section. He has played a leading role in a number of CBA submissions to government, including in relation to access to information and privacy laws and anti-spam legislation. He is also co-author of Electronic Evidence and E-Discovery, an accessible guide to e-discovery published by LexisNexis. He is lead author of the privacy compliance module for financial institutions and investment managers provided by Ethidex (ethidex.com).
Alex has received a number of prestigious commissions from the Office of the Privacy Commissioner of Canada (OPC), including in respect of: (a) PIPEDA and Your Practice — A Privacy Handbook for Lawyers, a national privacy handbook for the legal profession; (b) Leading by Example: Key Developments in the First Seven Years of PIPEDA, a milestone privacy law report; and (c) Metadata and Privacy: A Technical and Legal Overview.
In 2012, Alex obtained his doctorate in field of privacy law at the University of Ottawa under the supervision of Dr. Ian Kerr, Canada Research Chair in Ethics, Law and Technology.
